The prohibition against the use of force contained in Article 2.4 of the United Nations Charter is a cornerstone of the post-war legal order and ranks as one of the most fundamental rules of contemporary international law. While claims involving violations of this provision raise delicate political questions, the lawfulness of inter-state violence is by no means beyond judicial scrutiny. Through an analysis of the jurisprudence of the International Court of Justice (ICJ), this lecture examines the ICJ’s contribution to the definition of the regime applicable to the use of force among States. In so doing, it focuses in particular on the conditions under which self-defence may be legitimately resorted to and on the challenges posed by armed attacks by non-State actors with regard to a set of rules originally conceived to play at the inter-State level.
