  • Immunity of State officials from foreign criminal jurisdiction
    • The Chair of the Drafting Committee presented the report of the Drafting Committee on Immunity of State officials from foreign criminal jurisdiction (A/CN.4/L.850). The Commission considered the report and adopted the following draft articles: 2(e) (Definitions/Définitions) and 5 (Persons enjoying immunity ratione materiae/Bénéficiaires de l’immunité ratione materiae).
      • Statement of the Chair of the Drafting Committee.
  • The most-favoured-nation clause
    • In the absence of the Chair of the Study Group on the Most-Favoured-Nation clause, Mr. Mathias Forteau presented an oral report of the Study Group. The Commission took note of the report.

    • The Chair of the Planning Group, Mr. Shinya Murase, introduced the report of the Planning Group (A/CN.4/L.849). The Commission adopted the recommendations contained in the report of the Planning Group and decided (i) to include the topic “Jus cogens” in its long-term programme of work and (ii) to request the Secretariat to prepare a list of potential topics for the Commission, accompanied by brief explanatory notes, by the end of the quinquennium. The Commission took note of the report of the Planning Group.
