    • The Commission continued its consideration of the remaining parts of the second report of the Special Rapporteur, Mr. John Dugard (A/CN.4/514, Corr.1 and Corr.2) as well as the third report (A/CN.4/523).
  • Programme, Procedures and Working Methods of the Commission and its Documentation
    • The Chair of the Planning Group reported on the work undertaken thus far.
    • The Commission took note of the decision of the Planning Group to re-establish the Working Group on the Long-Term Programme of Work, to be chaired by Mr. Alain Pellet.
    • The Commission endorsed the suggestion of the Planning Group to include the following topics in its programme of work: International liability for injurious consequences arising out of acts not prohibited by international law, Responsibility of International Organizations, and Shared Natural Resources.
    • The Commission decided to establish a Working Group on International liability for injurious consequences arising out of acts not prohibited by international law, to be chaired by Mr. P.S. Rao, as well as a Working Group on Responsibility of International Organizations, to be chaired by Mr. Giorgio Gaja. The Commission further appointed Mr. Gaja as Special Rapporteur for the topic of Responsibility of International Organizations.
    • The Commission also decided to establish a Study Group on the topic of the Fragmentation of international law, to be chaired by Mr. Bruno Simma.
    • The Chairmen of the Working Groups and the Study Group made statements.

The Commission further decided not to refer draft article 16 to the Drafting Committee, but to include its contents in the commentaries. The Commission completed its consideration of the third report of the Special Rapporteur.

The Commission adopted the following draft articles on first reading: articles 1 (Scope) (Champ d'application), 2 [3] (Right to exercise diplomatic protection) (Droit d'exercer la protection diplomatique) and 3 [5] (State of nationality)(État de la nationalité) as orally amended.

    • The Commission heard a statement by the Representative of the Inter-American Juridical Committee, Ambassador Orlando Rebagliati.

    • The Commission continued its consideration of the report of the Drafting Committee on Diplomatic Protection (A/CN.4/L.613/Rev.1), and adopted draft articles 4 [9] (Continuous nationality)(Continuité de la nationalité), 5 [7] (Multiple nationality and claim against a third State)(Multiple nationalité et reclamation à l'encontre d'un État tiers) and 7 [8] (Stateless persons and refugees)(Apatrides et réfugiés). The Commission further adopted paragraph 1 of article 6 (Multiple nationality and claim against a State of nationality) (Multiple nationalité et réclamation à l'encontre d'un État de nationalité) on a provisional basis and decided to refer the title of article 1 as well as article 6, paragraph 2, to the Drafting Committee.

The Commission thus concluded its consideration of the topic.
